General Terms and Conditions for Transport Services

1. Provider and scope
These General Terms and Conditions apply to transport services provided by Barakat Transporta, owner Abdelaziz Barakat, Wartbergstr. 13, 74076 Heilbronn, Germany, unless otherwise agreed in writing.
2. Scope of services
Barakat Transporta provides courier services, goods transport, recurring routes, night transport, special runs and related transport services. The exact scope is determined by the offer, order confirmation or individual agreement.
3. Goods and exclusions
As a rule, only non-toxic, non-hazardous and legally permitted goods are transported. Excluded are dangerous goods, explosive, flammable, toxic, radioactive or infectious substances, illegal goods, weapons, narcotics, cash, securities, live animals and particularly valuable or perishable goods unless expressly accepted in writing.
4. Customer information
The customer must provide all information required for proper execution, including pickup address, delivery address, contact persons, phone numbers, time windows, weight, dimensions, packaging condition, loading conditions, floors, access routes and special requirements.
5. Packaging, loading and access
The customer is responsible for transport-safe packaging unless a packaging service has been expressly agreed. Pickup and delivery points must be accessible and suitable for the agreed vehicle. Waiting time, additional effort, special access routes or missing accessibility may be charged additionally.
6. Prices, offers and payment
Offers are based on the order details provided. If route, scope, waiting time, vehicle requirements, weight, volume or additional services change, the price may change accordingly. Unless otherwise agreed, invoices are payable without deduction within the stated payment period.
7. Dates and delivery windows
Dates and time windows are planned carefully. Traffic, weather, official measures, force majeure or incomplete customer information may cause delays. Fixed appointments are only binding if expressly confirmed.
8. Liability
Liability is governed by the applicable statutory freight law provisions where applicable. Liability for loss of or damage to goods may be limited by law. Further liability only applies if expressly agreed or required by mandatory law.
9. Customer cooperation and delay
The customer must ensure that the goods can be handed over and accepted at the agreed times. Delays caused by missing cooperation, incorrect information or unreachable contacts may result in additional costs.
10. Recurring routes
For recurring routes, scope, intervals, billing and termination periods are agreed individually. Changes to route, frequency or loading conditions must be communicated in good time.
11. Data protection
Personal data is processed solely to handle requests and carry out orders. Further details can be found in the privacy policy.
12. Final provisions
German law applies. If any provision is invalid, the validity of the remaining provisions remains unaffected.
